Yesterday, the Tennessee State Senate passed a piece of legislation that would make it harder for victims of medical malpractice to bring a lawsuit in the state by setting up additional barriers within the legal system. The House had previously passed the same bill – which means it is on its way to be signed by the Governor.
If only 2% of people injured by their doctors ever file a medical malpractice claim, how many Tennesseans with legitimate claims are going to be deterred by these additional barriers?
The only bright side is that the current bill does not include a cap on punitive damages – as was originally in the legislation.
