Its truly not my intention to make readers of this blog cringe. But after, I read this story from yesterday, my jaw dropped to the floor. Here is yet another example of medical negligence affecting an innocent patient's life forever. What's worse is that the error could have been prevented. From the story:
A Cincinnati area man says he has filed suit after his doctor partially castrated him, removing a testicle that was found not to be cancerous."
Stephen M. Kosti filed suit in Hamilton County Common Pleas Court seeking unspecified damages against Dr. Gary M. Kirsch, alleging medical malpractice, lack of informed consent and battery, reported the Dayton Daily News Wednesday...
Kosti alleges the doctor told him "that he may have cancerous cells in his testicle/scrotum to such an extent that he may live only another six months." A few days later, Kosti consulted an oncologist and had a PET scan done which scan indicated that the right testicle was not cancerous, according to the lawsuit.(Click here for the entire article)
Perhaps
even more cringe-inducing is the fact that Ohio passed one of the
worst rights-limiting tort "reform" measures just a few years ago
that imposed a harsh one-size-fits-all limit/cap on the amount of
compensation injured victims can receive for their non-economic or
"quality of life" injuries.
Every Ohio State Senator who co-sponsored the bill also happened to be
male.
Sometimes it takes a case like this for some politicians to understand what caps really mean for people. I wonder how Ohio legislators would have voted had Mr. Kosti's case happened by then.
