As if by magic, the day after we told you the Center for Justice and Democracy (CJ&D) had released a new report showing how devastating it would be for women if the Supreme Court opts to give drug companies complete immunity in the upcoming lawsuit Wyeth v. Levine, the news is flooded with stories about leaked documents showing how career people within the Food and Drug Administration (FDA) agree - immunity would be a terrible idea!
Yesterday, U.S. Rep. Henry A Waxman (D-CA) (pictured here), chairman of the House Oversight and Government Reform Committee, released a report about these incredible documents. In one, according to Waxman’s report, the guy who is in charge of FDA's new drug reviews said, “Much of the argument for why we are proposing to invoke pre-emption seems to be based on a false assumption that the FDA-approved labeling is fully accurate and up-to-date in a real time basis. We know that such an assumption is false."
In another, the associate director of the FDA's division for drug evaluation and research, proclaimed that the FDA’s rule supporting immunity for drug companies "is not, as it purports to be, consistent with the agency's role in protecting the public health."
Unbelievable. Let’s hope the Court takes notice.
