A new report released today and endorsed by a coalition of consumer organizations (including CJ&D!) shows that “despite rising malpractice insurance premiums over the past several years there has actually been a drop in medical malpractice payouts made by New York doctors.”
The report, entitled "Contraindication," and authored by members of the N.Y. Public Interest Research Group and Center for Medical Consumers:
• Calls for a “forensic review” of the business practices of malpractice insurers to identify why premiums have jumped, while payments are stagnant.
• Argues that the information clearly shows that insurance companies’ and medical lobbyists’ arguments of New York’s liability system being “out of control” were baseless.
• Highlights that, despite overheated claims by the medical lobby, New Yorkers enjoy one of the highest per capita number of doctors in the nation, including those in one of the so-called “high-risk” specialties.

The sliding scale of attorney compensation in NY has some impact as fees drops to 10% beyond 1.2 million. The will to fight beyond 1.2m only returns 10k for every 100k demanded.
